What happens, step by step.

    Either of you can start the conversation

    We need both owners to agree to a sale, but one of you can ask for the offer. We send it to both, in writing, at the same time.

  2. 02

    A written offer the next working day

    A firm price and a completion date. If a financial order is being worked out, the offer letter gives your family law solicitors a real figure to use rather than an estimate.

  3. 03

    One solicitor for the sale, one timetable

    Our partner solicitor can handle the sale for both of you, with fees paid by us. Any advice on how the money is split stays with your own family law solicitors, and we keep everyone to the same dates.

  4. 04

    Complete on the agreed day

    The proceeds are split as you have agreed and paid on the day. If one of you is still living there, the completion date is set around their move.

What you will need

  • Photo ID and proof of address for both owners
  • The mortgage statement and any secured loans
  • Any court order, consent order or separation agreement that deals with the property
  • Your family law solicitors' details, if they are dealing with the split

Good to know

The things worth knowing before you decide.

  • If only one of you is on the title

    A spouse who is not a legal owner may still have rights to occupy and to a share of the proceeds. Your solicitors will deal with this; it does not stop the sale but it does need to be sorted before completion.

  • Mesher orders and delayed sales

    Sometimes a court orders that the house is not sold until a child reaches a certain age. If that applies, we can still agree a price now and complete when the order allows.
